These terms and conditions govern your use of this training portal. By accessing our site, you agree to these terms and conditions in full. If you do not accept or do not agree with these terms and conditions or any part of these terms and conditions, you must not use our website.

1. LICENSE TO USE WEBSITE

Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website. All these intellectual property rights are reserved, subject to the license below.

Subject to the restrictions set out below and elsewhere in these terms and conditions, you may view, download for caching purposes only, and print pages from the website for your own personal use.

 

YOU ARE NOT PERMITTED TO:

  • Republish material from this website.

  •  Republish material from this website on another website.

  •  Sell, rent or sub-license material from this website.

  • Show any material from this website in public.

  •  Reproduce, duplicate, copy or otherwise exploit material on our website for a commercial purpose.

  • Edit, or otherwise alter any material on this website; or redistribute any material from this website except for content explicitly made available for redistribution (such as a newsletter).

2. ACCEPTABLE USE

You must not use our training portal in any manner that is illegal, unlawful, fraudulent or harmful, or in relation with any illegal, unlawful, fraudulent or harmful purpose or activity; or in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website.

 

You must not use our website to copy, store, transmit, host, send, use, publish or distribute any material which consists of or is affiliated to any spyware, computer virus, trojan horse, worm, keystroke logger, rootkit or other malicious computer software whatsoever.

Without our prior express written consent, you must not conduct any systematic or automated data collection activities including without limitation scraping, data mining, data extraction and data harvesting on or in relation to our website. You must not use our website to send or transmit unsolicited commercial communications. You must not use our website for any objective related to marketing without our prior express written consent. 

3. FLEXIBLE DELIVERY

Ocean International Training Academy provides flexible delivery with all its structured online educational courses. Students will be expected to complete their course requirements via an integrated system of online and hard copy assessments. Students are required to attend at least one live training so assessors can deem students competent of course components. Students will be responsible for having access to the internet for some or all of their course work. Only the DMC Full course have specific formal and informal assessments and live assessments, there is a prerequisite for students to attend one live training workshop - based on the sunshine coast where students will be formally assessed on capability this is essential to obtain a pass in the course . Students will receive a Free VIP ticket to this event valid for 6 months. However, if the student does not use this ticket within the 6 month timeframe they will have to purchase a seat for $499. Students are responsible for meeting all of these requirements. DMC lite students are not required to submit assessments therefore will not obtain a certificate of completion.

4. ONLINE COURSE MATERIALS

All course materials are provided as soft copy i.e. students are issued login and password details to access courses. Students who enrol and select the payment plan option have access to their course as they progress through their payment plan i.e. as your payments increase, the more course work you can access. In the event students find that their completion rate is quicker than their payment plan schedule, students are able to make payments in advance to access more course work.

5. INSTALMENT PAYMENTS

Please read and sign our payment plan agreement. A $10 fee will be applied if payment is late or declined.

6. NO FEE REFUND POLICY

We have “NO REFUNDS” for ‘change of mind’ policy. There is a 48 hour ‘cooling off period’ in the case of extreme circumstances money may be refunded.

7. LIABILITY

Being that the information we present in our training course pertains to a fluid and evolving industry we endeavour to ensure that the information on this website (excluding user content) is correct, we do not guarantee its correctness or relevance. The information we provide is based on our own best practice and research. Whilst we strive to have every member gain knowledge that can be applied practically we are not liable for the failure of students capacity to do so.

8. BREACH

Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, we may take such action as we deem suitable to deal with the breach, including prohibiting you from accessing the website, suspending your access to the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

9. CANCELLATION POLICY

Students wanting to cancel their course are required to fill out and submit the below Cancellation Request Form and email to info@oceaninternationaltrainingacademy.com within 48 hours Enrolment Date. It is recommended that you contact Ocean International Training Academy within 24 hours of submitting your Cancellation Request Form to confirm that your request has been received.

 

Requests for cancellations will not be accepted after 48 hours from your Enrolment Date and Students will be obligated to pay the course fees to Ocean International Training Academy in full.

10. REFUND POLICY

Your completed enrolment form acts as confirmation that you accept and commit to paying the fees, as they are stated on your student enrolment form and / or via a payment plan agreement. For any forms submitted electronically, in lieu of your signature, you will need to read and agree to the terms and conditions, Privacy Statement and Fees & Charges online to submit your form, by doing so you accept the terms and conditions fully. Electronically submitting an enrolment form confirms and verifies that the student has a full understanding of all terms & conditions, fees & charges and knowingly and willingly accepts all terms.

 

Distance, online students are considered to have commenced their course from the date that they submit their enrolment form. It is the students responsibility to ensure that they have a complete understanding of all course requirements prior to enrolling. Electronically signing these forms confirms and verifies that the student has a full understanding of all terms & conditions, fees & charges and knowingly and willingly accepts all terms.

 

Ocean International Training Academy reserves the right to withdraw any student from a course as a result of inappropriate behaviour and / or offensive language towards staff and trainers. In the event this occurs, students are obligated to pay out any outstanding fees owing and are not eligible for a refund of any kind.

 

If a student has paid in full and submitted the Ocean International Training Academy Cancellation Request Form within 48 hours from their Enrolment Date, a refund of up to 95% of the course less the $200.00 cancellation fee will be issued within 7 - 10 working days.

 

If a Student has enrolled with a payment plan and submitted Ocean International Training Academy Cancellation Request Form within 48 hours from their Enrolment Date, the deposit is non-refundable and a $200.00 cancellation fee is required.

11. TRANSFERS / DEFERMENTS

Students are not permitted to defer, however, they are permitted to transfer from one course to another.

 

Students who have paid their course in full can transfer to a course of equal or lesser value a $150.00 transfer fee applies. No refunds will be issued for any difference in the course price.

 

Students who have paid their course in full can transfer to a course of higher value and are obligated to pay the $150.00 transfer fee, plus the difference in course price.

 

Students who have enrolled with a payment plan can transfer to a course of equal or lesser value and a $150.00 transfer fee applies. Students must continue to pay their original payment plan (i.e. your existing payment plan course total will not change in price).

 

Students who have enrolled with a payment plan can transfer to a course of higher value and are obligated to pay the $150.00 transfer fee, plus the difference in price, which will be added onto their existing payment plan total.

 

A course cannot be transferred from one student to a different individual to complete. It is the students responsibility to ensure that they are completely knowledgeable with all course requirements prior to enrolling. By electronically signing prior to submitting an enrollment form confirms and verifies that the Student has a full understanding of all terms & conditions, fees & charges and knowingly and willingly accepts all terms.

12.  EXTENSION 

Students can obtain a 1-month extension at no charge for their course and the 1-month extension is valid to commence from the original course expiry date (Course timeline is 12 months)  Additional months can be purchased at $50.00 per month, maximum 3-months applicable. The additional 3-months are consecutive and commence at the conclusion of the free 1-month extension.

 

Students paying for the Full DMC course can obtain a 1-month extension for their 6-Month access to their success coach - Additional months can be purchased at $50.00 per month until the original course expiry date (Course timeline is 12 months)

13.  APPEALS PROCEDURE

You may request a Not Yet Competent (NYC) assessment result to be reviewed for up to 21 days from when the result is issued. Requests for a review of an assessment item must be made in writing to the Academy Assessment Officer: hannah@oceaninternationaltrainingacademy.com

14. GENERAL

All Ocean International Training Academy courses have a specific maximum completion time of 12 months. This time period includes any live training and assessments online or any other assessment items. All students will be issued with completion dates for their course or modules to ensure they meet the time frame above. Ocean International Training Academy reserves the right to change course materials, change/modify assessment items or to cancel courses if necessary. In the event of a course or module being cancelled every effort will be made to avoid inconvenience by transitioning students to other courses or modules. Upon enrolment students are confirming they have read the course information, course outline, terms and conditions, therefore the student is aware of the requirements and structure of the course. Electronic signature when submitting an enrolment form confirms and verifies that the student has a full understanding of all terms & conditions, fees & charges and knowingly and willingly accepts all terms.

15. GRIEVANCE AND STUDENT COMPLAINT POLICY

If a student has a minor grievance or complaint, they can email the Ocean International Training Academy: info@oceaninternationaltrainingacademy.com. All grievances will be treated with confidentiality and will not be detrimental to the student initiating the complaint.

16. VARIATION

We may revise these terms and conditions on occasion. Such revised terms and conditions shall apply to the use of our website from the date of the publication of the revised terms and conditions on our website. To ensure you are familiar with the current version please check this page regularly.

17. ASSIGNMENT

We may transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.

We do not permit you to transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

18. EXCLUSION OF THIRD PARTY RIGHTS

These terms and conditions are for the benefit of you and us and are not intended to benefit any third party or be enforceable by any third party. The exercise of our and your rights in connection to these terms and conditions is not to be subject to the consent of any third party whatsoever.

19. ENTIRE AGREEMENT

These terms and conditions, together with our privacy policy, constitutes the entire agreement between you and us in regards to your use of our training portal and supersedes all prior agreements in respect of your use of this training portal.

 

Note: We reserve the right to change our terms and conditions at any time without any notice. Every participant has to follow these updated terms.
